On the heels of the EU passing the first multinational law regulating AI, Tennessee becomes the first US government entity to pass music-specific AI legislation. The ELVIS Act updates TN's personal rights protection law to include "protections for songwriters, performers, and music industry professionals' voice from the misuse of artificial intelligence."The law is somewhat narrow, but it does protect singer's voices from being cloned & used without their permission. Why Tennessee? Per capita, music is incredibly important to the state's economy: It employs over 61k people and adds $5.8B to the state's GDP. AI certainly has its advantages.But, some choose to leverage it the wrong way.The music industry has been under heat for this in the past 🎵To the point where Tenessee has put the Elvis Act into place to take action against plagiarism 🚨The Elvis Act (Ensuring Likeness, Voice, and Image Security) is a testament to protecting the state's rich musical heritage and commitment to supporting its artists.It ensures an artist's voice cannot be replicated without their consent.A highly common misconception about AI is that it can do everything a human can, better and faster.AI is a tool to ENHANCE human abilities, not replace them altogether. My take: agents need to get smart on how to make sure their clients receive proper royalties from the use of AI. Conceptually this should supercharge income for these artists without them having to do as much work. Good IP lawyers & amazing agents will become increasingly important for artists across the board. Don't run from AI - work with AI companies, educate yourself / your team, and learn how to use it to your advantage.#ai #music #entertainment #aiforartists

How much will this come down to fan activity?If fans are to trust that what they're spending their money on is music or art genuinely from the artist, do they have the right to seek compensation if it turns out to be AI imitation of them? Would consumer protection law factor in here, in some way, down the line?Will opt-in or mandatory track labelling become a thing - '100% made by this artist'? Fans can then decide for themselves what they listen to and where they spend their money.And what about platforms? Last year, Spotify made it clear they wouldn't ban all AI-made music. This issue is truly central in the generative AI debate. Another I foresee percolating is whether copyright/patentability is compromised when a publicly accessible generative AI tool (such as ChatGPT) is used to write code or debug code. Assuming exposure in a non-confidential environment is not dispositive (and that is a BIG supposition), what metric(s) might be used to determine that answer, e.g., percentage of human proprietary vs AI authorship?
